The IP High Court Releases Recent IP Litigation Statistics in Japan
On June 23, 2023, the IP High Court released recent IP litigation statistics in Japan. Some key facts are below:
- In 2022, the number of new IP cases filed in district courts decreased by 9.72% from 2021 (from 617 cases in 2021 to 557 cases in 2022).
- Average length from filing to termination for IP cases at district courts remained the same in 2021 and 2022 (about 15.2 months on average).
- Winning rate of the patentee in patent infringement cases among the cases in which judgment was rendered during the period from 2014 to 2022: 30% (154 cases out of 519).
- Number of cases in which the patentee awarded over 100-million-yen damages during the period from 2014 to 2022: 35 cases.
